Terms and Conditions of Carriage

1. Introduction

1.1 These terms and conditions are set out on the basis that Global Express UK Ltd will transport packages, documents. These terms are supplemented by the current service and tariff guides. The guide contains information about the services provided by Global Express UK Ltd which the shipper should read and which form part of the agreement between Global Express UK Ltd and its clients.

1.2 Where carriage by air invoices an ultimate destination or stop outside the country of origin the Warsaw Convention may apply. The Warsaw Convention governs and in most cases limits the liability of carriers in respect of loss or damage or delay to cargo. (for the purpose of these terms the phrase the Warsaw Convention means (i) the convention for the unification of certain rules relating to International carriage by Air signed at Warsaw on the 12th October 1929 or (ii) that convention as amended or supplemented by any protocol or supplementary convention or(ii) the Montreal Convention 1999, whichever is applicable.) notwithstanding any clause to the contrary, the international carriage by road may be subject to the provisions of the Convention on the Contract for the international carriage of goods by road signed at Geneva on the 19th May 1956 (the CMR Convention).

1.3 A shipment may be carried via any intermediate stopping places that Global Express UK Ltd deem appropriate. Global Express UK Ltd may engage in sub contractors to perform services and contracts both on its own behalf and on the behalf of its clients, agents, and sub contractors each of whom shall have the benefit of these terms.

1.4 In these terms, airway bill shall mean a single Global Express UK Ltd airway bill/consignment note will be issued against the date /address and service level on the pick up date. All shipments covered under an airway bill shall be considered a single shipment.

Conditions of Carriage

2. This section set outs various restrictions and conditions which apply to the carriage and handling of packages, documents. It also explains what consequences are of the shipper presenting packages for carriage which do not meet these requirements.

Service Restrictions and Conditions:

Packages must not weigh more than 50 kilograms or exceed 270 centimetres in length or a total of 330 cubic inches in length and girth combined.

The value of any packages must not exceed the local currency equivalent to USD 500.00. 

Packages must not contain any prohibited articles listed in the Global Express UK Ltd Guidelines. Items of antiques, professional art, precious stones, stamps, credit cards, cash , silver, and gold and also negotiable instruments such as cheques, bills, bonds, jewellery including watches,saving books, firearms, and dangerous goods.

Packages must not contain goods that can endanger human or animal life or any means of transportation, or which might otherwise taint or damage other goods whilst in transit.

The shipper will be responsible for the accuracy of compliance with these restrictions and ensure true and correct information is recorded on the air way bill/invoice. All packages must be marked and labelled correctly to ensure smooth transit to final destination. Unless a different service level is clearly marked on the airway bill, shipments will be carried under the Express Service Criteria and all charges will be calculated accordingly.

The shipper guarantees that all packages presented for carriage under the terms comply with the restrictions(i) to (iv) above and have been prepared in secure premises, by him/her.

2.1 Perishable and temperature sensitive goods may be carried and transported provided that the shipper accepts that this is at their own risk.
Global Express UK Ltd does not provide handling for these shipments.

2.2 Refusal and Suspension of Goods

If it comes to the attention of Global Express UK Ltd that the above restrictions have not been met, then the shipment may be held and refused for carriage and the shipper advised. Where Global Express UK Ltd has detained a package, the shipper will be contacted and will need to arrange either return of goods or authorise inspection of package.

2.3 The shipper will be responsible for the reasonable costs and expenses of Global Express UK Ltd (including storage) for such losses, taxes and customs duties/fines as Global Express UK Ltd may suffer and all claims made against Global Express UK Ltd because a package does not meet any of the restrictions, conditions in the above guidelines.

2.4 If the shipper tenders to Global Express UK Ltd and fails to comply with any of the restrictions listed in paragraph 2.1 above without Global Express UK Ltd's written consent, Global Express UK Ltd will not meet any losses, however if the shipper suffers in connection with the carriage whilst in the care of Global Express UK Ltd , then the shipper will be entitled to any carriage or handling charges that may apply.

2.5 Global Express UK Ltd reserves the right, but is not obliged to open, inspect or scan any package tendered to it for transportation at any time.

2.6 Where a packages requires customs clearance, it is the responsibility of the shipper to provide accurate documentation for the purpose of the import clearance to the specified country. Global Express UK Ltd will only act upon the paperwork provided and will take the necessary action to avoid any delays.

Payment Terms

3.1 The rates of carriage and other services are set out in the tariff guide and unless paid before shipment, or agreed fixed costs/discounts that may apply. All charges must be paid by the 28th day of the following month or within such other period as the shipper may have agreed in writing with Global Express UK Ltd.

Global Express UK Ltd may verify the actual weight or dimensional weight of the package and if greater than the declared weight, invoice on such basis and confirm in writing. Unless proved otherwise, an invoice shall be considered for this purpose to have been received within 3 business days following the date of the invoice.

3.2 If Global Express UK Ltd is required to pay any taxes, duties or levies on behalf of the shipper, receiver or third party, then carriage of goods will be invoiced in accordance with shippers request. Any failure by the shipper or receiver of the goods to provide correct documentation or any permits or licences required in connection with carriage, then in each case (without prejudice to the shippers contractual liability for payment) the receiver or, where applicable, third, will initially be charged by Global Express UK Ltd for payment.

3.3 If the sum is not paid by the shipper , receiver or some other party under these terms, Global Express UK Ltd may hold packages until it receives full payment of outstanding balance. Any unpaid balance will remain payable.

3.4 Invoice queries must be forwarded in writing to Global Express UK Ltd within 7 days of receipt of weekly invoice.

Liability

4.1 Where Warsaw or CMR Conventions or any national laws implementing or adopting these conventions may apply (for convenience referred to as the Convention Rules) or where (and to the extent that) other mandatory national law applies; the liability of Global Express UK Ltd is governed by and will be limited according to the applicable rules.

4.2 Where conventions rules apply or other mandatory national laws do not apply, Global Express UK Ltd will be liable for failure to act with reasonable care and skill and its liability shall be exclusively governed by these terms:

(i) GBP 50.00 per shipment in the case of goods presented in the UK to Global Express UK Ltd for carriage or

(ii) 8.33 Special Drawing Rights (SDRfS) per kilo of goods affected.

4.3 Subject to provisions in paragraph 4.4, the shipper may claim greater limit of liability of shipment, when an additional charge has been accepted for insurance of goods in transit. The value of goods shall not exceed USD 500.00.

4.4 Global Express UK Ltd will not be liable for any loss or damage of any packaging.

Data Protection

5. The shipper agrees that Global Express UK Ltd and its serving partners, including companies overseas which may not have the same data protection as the country where the shipment is presented for carriage, may use any data provided by the shipper to Global Express UK Ltd for management analysis and monitoring. The shipper has certain rights under the law, to have access to, rectify or object to the use for direct marketing of, or delete personal data held by Global Express UK Ltd about it.

Claims procedure

6. All claims must be notified in writing as soon as reasonably practicable and in any event within 7 days of receipt of damage (including partial loss of shipment), in the case of delay within 14 days of the goods being placed at disposal of the person entitled to delivery. This term shall not affect any rights the shipper may have under Convention rules or other mandatory national laws.

Agreement

7. It is the intention of Global Express UK Ltd that all terms of contract between it and the shipper are contained in this document and in the guide. If the shipper wishes to rely on any variations to this agreement and terms, and then it must be recorded and signed by the shipper and on behalf of Global Express UK Ltd before the shipment is accepted for carriage.

 
Please note that these terms shall be governed by the laws of the country where the shipment is presented for carriage.

Prohibited articles and service restrictions

Alcoholic beverages / Animal skins / Articles of exceptional value (eg, works of art, antiques, precious stones, gold and silver). Dangerous goods(following IATA regulations for Express and ADR travel / Firearms / Furs / Ivory / Jewellery and watches / Live animals / Money, negotiable items and pre paid cards / Perishable goods / Personal effects containing restricted items / Plants / Pornographic materials / seeds / Tobacco & products associated / Unaccompanied baggage ( except for prior approval of Destination).
